Marbury v. Madison - Legal Case



It is indeed true that Marbury v. Madison is regarded to be one of the significant cases in which the Supreme Court extended a ruling. It will be really apt to delve on the circumstances and the actual significance of this case, considering its application and importance. This case brought to fore many important legal issues. Marbury v. Madison gains its importance and relevance from the fact that it happened to be a Supreme Court case in which the honorable court laid down the grounds for the exercise and application of the legal power of judicial review. In a way it would be pertinent to say that this Supreme Court ruling went ahead to decide the boundaries specific to the judicial branch and the executive branch of the United States government.

Legal CaseThe circumstances of this case were such that preceding the actual inauguration of the US President Jefferson, the sitting President Adams in an attempt to consolidate and strengthen the Federal say in the American judiciary, brought to fore new judicial positions and nominated many Federal appointees to fill those judicial positions. In pursuance of this policy, President Adams in tandem with the Organic Act of District of Columbia appointed many new judicial appointees to fill the position of the justices of peace for this specific district. These judicial appointments were officially confirmed and approved by the Senate only a day prior to President Jefferson was inaugurated. The thing was that some of the above mentioned commissions were officially undelivered. Hence, as President Jefferson assumed office he conveyed to the then Secretary of State named James Madison to not to deliver these commissions. Subsequent to this one of these appointees Marbury sought Mandamus by the Supreme Court. The question that the Supreme Court was to decide was as to whether Marbury qualified to request for a mandamus by the Supreme Court.

In this Supreme Court ruling the majority opinion declared that Marbury had the right to request for a writ for mandamus yet Section 13 of the Judiciary Act of 1789 extending the actual jurisdiction of the Supreme Court of America happened to be unconstitutional. The Court also went ahead to declare that it was the solemn duty of the courts of law in the United States of America to protect and uphold the legal rights of the people. The courts were supposed to uphold these rights even if they went contrary to and against the wishes and intentions of the President of the nation.

The relevance of this case was that it established and consolidated the power and privilege of the Supreme Court to determine and ascertain whether and particular law passed and approved by Congress happened to be constitutional or not. Before this Supreme Court ruling it was accepted that any law contradicting the US Constitution happened to be unconstitutional. Yet, it was not known as to which branch of the government was entitled to determine the constitutionality of such laws. This Court ruling established and brought to fore the legal power of the judicial review. This consolidated and bolstered the systems of checks and balances required for strengthening the US democracy.

It needs to be mentioned that the Supreme Court ruling in Marbury v. Madison happened to be ground breaking as it established and consolidated the power of the judiciary as being a potential and pragmatic partner along with the Executive and Legislative arms of the American democracy. College Research: Situation when I used Inductive Reasoning



Inductive reasoning pertains to an approach towards reasoning that takes into consideration some specific information, and induces a wider generalization, which may be regarded to be accurate, while entertaining the possibility that the given conclusion may not be true (Feeney & Heit 2). I do use inductive reasoning while dealing with personal problems.

Inductive Reasoning StudyThe last situation in which used inductive reasoning was to sort out my feelings regarding my fast friend Emanuel. It happened that Emanuel made a comment pertaining to my character and personality. He told me that "I was a very lazy person". I considered this comment to be really painful as I am proud of my work ethics and hard working personality. In that sense it really hurt my sense of pride and self esteem. This particular comment really compromised my self-concept. I got really enervated by his comment as I later pondered on it. I felt really irritable about and rather angry with Emanuel for calling me a "lazy person". I thought of confronting Emanuel because of the personal comment he made about me. However, engaging in inductive thinking prevented me from doing so.

I applied inductive reasoning in this specific scenario in this particular format. I considered a number of premises before deciding to have an argument with Emanuel. The first premise that I considered was "Emanuel is a good friend who will scarcely think about hurting me for no reason". I found this premise to be true most of the times. I was factually sure that Emanuel was a good friend of mine who seldom acted mean.

The next premise that I considered was "Emanuel will always criticize me keeping my best interests in mind". Again, I found this premise to be true and right most of the times. The next premise that I considered was "In the past Emanuel never deliberately hurt me". As the other two premises that I considered, again I found this premise to be accurate. Considering these three premises led me to the following conclusion, "Therefore I should not get angry with any person who criticizes me to do good to me." Hence, going by this inductive reasoning, I arrived at the conclusion that I should not mind Emanuel's comment because he criticized me keeping my best interest in mind. I used multiple premises associated with my relationship with Emanuel to arrive at the final conclusion. I arrived at a generalized conclusion after considering several specific pieces of information.

I must say that I was able to reason successfully in this particular personal situation. Had I not engaged in inductive reasoning while making a decision, I will have certainly confronted Emanuel about the comment he made pertaining to me. Perhaps, this will have made me loose a good friend. Certainly, inductive reasoning helped me in this particular scenario.

DiaryHiroshima Diary was written by Japanese doctor Michihiko Hachiya in the two months following the dropping of atom bomb on Hiroshima. Hiroshima Diary extends an actual account of experiences of Hachiya after the atomic blast. Hachiya served as a director at Hiroshima Communications Hospital. He resided near the hospital. His home was situated about a mile from the place where the blast took place. In Hiroshima Diary, Michihiko Hachiya vividly catches the suffering and experiences of those people who suffered from the atomic blast at Hiroshima.

As per Hachiya, the impact of atomic bomb blast was so potent that it ripped apart all the clothes he was wearing on his body. Both Hachiya and his spouse suffered serious burns following the blast. The way Hachiya describes his arduous journey to the hospital is indeed touching and moving. Hachiya was extended care and treatment by those hospital personnel who somehow did not accrue grave injuries owing to the blast. After reading Hiroshima Diary, readers come to get a feel of the confusion, pain, frustration, and apprehension marking the people who managed to survive the blast. Hachiya not only realistically illustrates the effects of radiation poisoning on the patients he treated, but he also delineates accurate and credible details of their ailments. He convincingly describes the serious and painful medical conditions they suffered from after the blast. The book offers a heartbreaking description of what it is like to be a victim of an atomic blast.

As per the writer, it is really important for the future generations to remember the devastation and suffering caused by the atomic blast at Hiroshima. In the book Hachiya also delves on the ethics of using atomic weapons. While talking about the blast, Michihiko Hachiya no way tries to blame anyone for the destruction that took place at Hiroshima, by the atomic weapon. He rather tries to look into the essentials of human spirit that is able to retain its innate dignity, esteem, and hope, even after suffering such a painful and agonizing tragedy. Thereby, this book is an important historical and literary text.
