Pending lawsuit against Ben Roberts of 24houressay.co.uk

I have received a tip that ET and its affiliated companies are filing a lawsuit in the UK against "Ben Roberts," agent of the following sites:

24houressay.co.uk
24houressay.com
essaytips.eu
madissertations.co.uk
oxfordessays.co.uk

Published addresses:

101b Killigrew Street
Falmouth
Cornwall
TR11 3PU
United Kingdom
enquires@24houressay.co.uk

26 Wood Lane
London W12 OHT
W12 OHT
Voice: 447974436537

Mr. Roberts has committed serious legal offenses by simultaneously violating the Federal trademark of ET and libeling the company's name for unfair, commercial advantage. For an extended period of time, Mr. Roberts has been publishing ET's trademarked name (and that of completely unrelated EssayScam.org) in the meta tags of the "SCAM WARNING" page of 24houressay.co.uk :

meta name="keywords" content="essay writing company, essay scams, essayscam, essayscam.org, essay[]town, complaint, essay writing scam companies" /

24houressay.co.uk defamation

SOURCE:
24houressay.co.uk/scams.html
---------------------

I've been assured that all evidence was long-ago archived and forwarded to ET's attorneys as exhibits in the pending lawsuit in UK court, so my posts here will not compromise the prosecution's case in any way. Legal action in the US District Court of New Jersey is also in process, wherein ET will surely seek injunctive relief from US search engines.

By the way, while browsing 24houressay.co.uk, I noticed that Mr. Roberts blatantly misrepresents-to the potentially substantial detriment of unwitting clients-that 24houressay.co.uk's use of Turnitin's WriteCheck paper scanner will not (and effectively will never) cause a copy of each customer's paper to be copied, reproduced, and forever stored by Turnitin.com and its parent company, iParadigms, for commercial gain. From 24houressay.co.uk :

---------------------
Writecheck is a system run by Turnitin, but it's designed specifically for students who want to check their work for originality before they submit it to their tutor. The big advantage of Turnitin Writecheck is that it doesn't store a copy of your essay, so it won't show up later if you have to scan the work through Turnitin during submission.

24houressay.co.uk/writecheck.html
---------------------

As the agent of 24houressay.co.uk, this is a great marketing tactic for Mr. Roberts; the problem is that he has absolutely no authority-or legal standing-to make such a claim about the harmless, non-reproductive nature of Turnitin's proprietary WriteCheck service as it relates to his third-party essay service. In fact, Turnitin.com directly contradicts Mr. Roberts' promissory marketing ploy in the small print of the "User Agreement" for WriteCheck:

---------------------
License to Use Papers Submitted.
With regard to papers submitted to the Site, You hereby grant iParadigms a non-exclusive, royalty-free, perpetual, world-wide, irrevocable license to reproduce, transmit, display, disclose, archive and otherwise use in connection with the Services any paper You submit to the Site. Please note that papers submitted to the Site are not read or reviewed by any individuals, but rather are only analyzed using the Service.

SOURCE: writecheck.com/pricing_signup.asp
---------------------

The User Agreement of WriteCheck is nearly identical to that of Turnitin's standard service in that it gives Turnitin utter, absolute, unfettered control of the submitter's intellectual property without giving the submitter a dime, regardless of whether or not the submitter-often a student in a hurry and/or an ESL speaker-reads or understands the "fine print" that makes Turnitin.com so very profitable for its owner. As clearly dictated by the WriteCheck contract itself, Turnitin has the legal right to use-and profit from-ANY paper submitted to WriteCheck in ANY way that Turnitin wishes, with complete disregard for the subsequent wishes of the original author (i.e., "submitter"). Turnitin did not include the "irrevocable" wording by accident.

NOTE: Turnitin (iParadigms) is overwhelmingly demanding in its contractually-dictated, legal right to unilaterally control, reproduce, and greatly profit from its customers' submissions of intellectual property, but-not surprisingly-iParadigms takes the exact opposite stance when it comes to its own copyrights and fees:

---------------------
You may not remove any proprietary notices (e.g., copyright and trademark notices) of iParadigms from the Site, Services, or Reports. All fees paid by You for the Services and Site are non-refundable.

Pending lawsuit? Serious legal offences? You should educate yourself about legal aspects:

"The European Court of Justice has ruled in favour of Google in a dispute with luxury goods maker LVMH.

The firm is owner of Louis Vuitton, Moet & Chandon champagne, Dior perfume and other brands.

It had claimed that Google's practice of selling keywords in advertising searches to the highest bidder damaged trademark law.
"

news.bbc.co.uk/2/hi/technology/8582404.stm

A company can use any keywords (even trademarked) as much as they want. Meta description tag? Even Google admitted it doesn't use it any more in rankings.

Now you owe me $$$ for saving you money, you won't save your reputation though as it's been long gone :).

You need to learn how to read, YURI. There will be multiple complaints in the case. It's not just about the trademark in the meta tags, it's also about libel and unfair competition. (By the way, Google's commercial sale of keywords-especially in the EU-has absolutely NOTHING to do with misappropriating a US Federal trademark to defame a competitor for unfair, commercial advantage. Go TO school, nitwit.)

Your sites are next. By the way, Yuri, I hope you enjoyed how I gave my evidence to ET concerning your defamation and trademark theft at Best Essay Tips. LMAO! Did you enjoy ET's email?

I know a LOT of things that you don't. Enjoy the anticipation, tiny man.

:)

So why did you bother to do a screenshot of using keywords when you now admitted the claim is completely baselsess and invalid? 24houressay, as you presented, is in the UK so US trademark laws don't apply (even if they did they would be equally invalid).

You know a lot of things? Anticipation? Could be as tough as anticipation of a big earthquake in California.

I can only feel sorry for your customers, your daily job must be intimidating/threatening/harassing them every day. You probably enjoy it too. It's sad.

I don't have any customers, Yuri. Sorry. (Your ignorance is what has gotten you into some very serious legal predicaments, so, for your own good, you should probably just shut up.) However, my "daily job" is to vex fraudsters and con-artists like you.

Have a wonderful night.

PS: Would you like me to post your (and Olga's) extensive, public, criminal and civil court records, Yuri? Keep pushing me, and you will fall harder and even more quickly. If you want me to keep embarrassing you, post in one of the essaywriters.net threads.

"Kevin" should pay very close attention to this thread in the coming days, as Mr. Roberts is not the only defendant.

;)

As I find out more information, I will post it here.

'WritersBeware" AKA notorious liar and libellous piece of crap who has no life so posts lies on here every day, should pay more attention to her doctor and keep taking her medication.

Your threats and lies mean nothing WB - they just show you to be a paranoid deluded fantasist who persists in accusing posters of being people they are not, as you have accused so many in the past, and so many legit companies of being scams too.

Who is WritersBeware? An idiot. Yes. A poor paranoid schizo loonie. Sure. A loser. Definitely. A legal expert. NOPE. An expert on anything at all? NOPE. A teller of truth. NO WAY. Someone who anyone sane listens to. NO NO NO! WRT licking your fat asss and agreeing with you just proves what a pair of retarded nutters you are.

You PROVE again what a libellous lying piece of filth you are by accusing me of being someone I am not; then you threaten me by stating I should somehow be worried or afraid of you or any legal action!!!! IDIOT! I am NOT a scam essay site owner or writer (UNLIKE YOU) so why should any legal action against anyone worry me?

As usual, THE DELUSION IS ALL IN YOUR LITTEL ADDLED BRAIN.

WB you are SUCH a prat! Keep taking the medication - or you'll be ranting and raving again... while promoting the cheap shabby crappy company Essay T and dissing all companies you are ignorant of - who have chosen to removev themselves from this SCA<M FRAUDULENT essayscam site. Good for them! This sewer is full of dirt like you and lies spout like liquid ***** from your big gob all day long.

FOR HER LIBEL AND LIES WRITERSBEWARE SHOUDL BE BANNED.

WILL SHE BE? NO.

WHY? BECAUSE ESSAYSCAM IS A SCAM AND FRAUDULENT AND CORRUPT SITE RUN BY FRIENDS OF THE SCAMMER KNOWN AS WRITERSBEWARE (WHO IS TOO SCARED TO REVEAL HER REAL NAME HERE BECAUSE THEN WE'LL ALL KNOW WHO SHE IS - A SCAMMER!)

WB, I suspect that you are too proud to actually look up "fraud" and "con-artist" in the dictionary, and I respect that. but, will you at least look up "job?"

your daily job must be intimidating/threatening/harassing them every day.

I guess he finally got tired of being one ofthe biggest bullies at this forum. Or, his big mouth and constant baiting of users finally landed him a legal mess that forced himto quiet down. Whatever the reason, his disappearance has brought peace and more logical, rather than argumentative discussions to the threads. While hisinformation was useful, the methods he used to shareit were harmful to people he did not personally know.

Gee, I tried to look up this lawsuit online, just to see where the case is headed or, if it had been resolved already by the time of this posting. Somehow, I could not find any court records to indicate what happened to this case. I mean, it appears to be a highly controversial and well documented legal proceeding so, I was really interested in finding out how everything turned out. It appears that without WritersBeware to keep us updated about the court proceedings, we do not have anything to go on with regards to this case. However, since the url's provided here now lead mostly to dead-end urls, it is safe to assume that Ben Roberts got out of the business. Did it have anything to do with the lawsuit? That, we will never know.
